GOVERNING PROVISIONS

No one is authorized to change the terms and conditions of this tariff. Expressed or written authorization is invalid. Changes are allowed only by amending the tariff and publishing a revised edition through Bricks Transport.

Uniform Bill of Lading:

All consignments negotiated by Bricks Transport shall be subject to the Uniform Bill of Lading published by The National Motor Freight Traffic Association. Any Bill of Lading, or other instrument, negotiated to, or from, Bricks Transport shall serve as a receipt for goods only. No one is authorized to change the terms of the Uniform Bill of Lading published by The National Motor Freight Traffic Association.

Limitations of Liability:

The maximum amount of cargo insurance provided by Bricks Transport. is 50 cents per pound, or $250.00 per consignment, which ever is less.

Full value coverage for the invoice amount may be obtained if the following conditions exist:

  1. The declared value is shown in the proper place on the Bill of Lading.
  2. Additional premiums are agreed to, and paid to, Bricks Transport., in the amount of $1.50 per $100.00 additional insured value. Values of less than $5,000.00 will not be insured unless a minimum premium of $75.00 is agreed to.
  3. All merchandise transported must comply with, and be subject to all the conditions imposed by item 1610 of this tariff.
  4. All transportation charges due Bricks Transport. must be paid in full in order to begin any claim process.

Bricks Transportation, Inc. as Agents:

Definition:
Any consignment negotiated through Bricks Transport. on Primary Carrier issued Bill of Lading.

The Primary Carrier assumes all risk of the declared value shown on the Primary Carriers Bill of Lading. The Primary Carrier issuing the Bill of Lading is responsible for insuring the coverage for any excess value declared by the shipper. Bricks Transportation, Inc.. maintains minimum liability unless prior written consent is obtained and additional premiums are paid in advance.

Special or Consequential Damages:

Bricks Transport. will make all reasonable efforts to affect conveyance. Damages resulting from delay or non delivery can not be assumed by Bricks Transport. Natural or man made obstructions will relieve Bricks Transport from any liability with regards to any implied time limitations. Special or consequential damages shall be limited to the transportation charges assessed by Bricks Transport.

Bricks Transport does not accept nor access any administration fees associated with a claim process.
